機械規則（Regulation (EU) 2023/1230）は、従来の機械指令（Directive 2006/42/EC）を置き換える新しい規則であり、2023年6月14日に欧州議会と欧州理事会によって採択されました。この規則は、2027年1月20日からEU市場に出されるすべての機械製品に適用されます。これに伴い、機械製品のEU適合宣言書（Declaration of Conformity, DoC）の作成方法にも変更点があります。技術者や品質管理担当者にとって、この宣言書はCEマーキングを取得し、製品をEU市場に投入するための必須文書です。

本記事では、EU適合宣言書の基本構成、変更点、実務で注意すべきポイントを解説します。

1. EU適合宣言書とは？

EU適合宣言書は、製造者が自社製品がEU規制に適合していることを公式に宣言する文書です。部分的に完成した機械（Partly Completed Machinery）は除外され、市場に出された状態の完成品に対して作成されます。

この宣言書は、製造者の単独責任の下で発行され、CEマーキングを添付する際の技術的証拠としても重要です。

2. EU適合宣言書に必須の項目

EU適合宣言書には、少なくとも以下の情報を含める必要があります。

① 製品情報

  • 製品名、型式、バッチ番号、またはシリアル番号
  • トレーサビリティを確保するために、必要に応じて鮮明なカラー画像を添付可能

② 製造者・委任代理人情報

  • 製造者の氏名・住所
  • 必要に応じて委任代理人（Authorized Representative）の氏名・住所

③ 恒久設置の機械の場合の設置住所（NEW）

  • 建物または構築物内に設置される昇降機械の場合のみ、機械製品が恒久的に設置されている住所を明記

④ 製造者の責任表明

  • 「この宣言は、製造者の単独責任で発行される」という文言を必ず記載

⑤ 適合法令の明示

  • 宣言する製品が適合するEUの整合指令・規則を明記
  • 例：機械規則（(EU) 2023/1230）、低電圧指令、EMC指令など

⑥ 適用した規格・技術仕様

  • 関連する整合規格（Harmonised Standards）やその他技術仕様の参照
  • 規格の日付や仕様の日付を明示

⑦ 通知機関(NB)による型式検査（Module B）の情報

  • 該当する場合のみ
  • 通知機関(NB)の名前・番号、型式検査証明書の参照を記載

⑧ 適合性評価手順の記載

  • 内部生産管理（Module A）または完全品質保証（Module H）
  • 通知機関の監視下で実施する場合は、名前・番号を明記

⑨ 追加情報・署名

  • 製造者または代理人の署名
  • 発行場所と発行日
  • 名前・役職・署名

3. 現行機械指令からの主な変更点

  1. 恒久設置の機械の設置住所
    • これまで規定がなかった「建屋や構造物に恒久的に設置される昇降機械の住所」を追加。
  2. コンパイラ（編纂者）の記載義務が廃止
    • 宣言書作成者の役職名や編纂者情報の記載は必須ではなくなった。

4. 技術者・実務担当者が押さえるべきポイント

  1. CEマーキングと連動する文書
    • EU適合宣言書は、CEマーキングを製品に添付する際の公式文書であり、技術文書（Technical File）と連携して作成する必要があります。
  2. トレーサビリティの確保
    • 製品情報（型式・バッチ・シリアル番号）と設置場所の明示で、製品事故や回収時に迅速に対応可能。
  3. 通知機関(NB)との関係
    • 型式検査や品質保証に通知機関を利用した場合は、必ず名称・番号を正確に記載。
  4. 多指令対応の宣言書
    • 製品が複数の指令対象（低電圧指令、EMC指令、機械規則など）の場合、1枚の宣言書で全ての指令に適合していることを示すことが可能。
  5. 署名と責任
    • EU適合宣言書は、製造者の法的責任を伴う文書です。署名者は自社で正式に権限を持つ人物である必要があります。

EU DECLARATION OF CONFORMITY OF MACHINERY PRODUCTS EXCEPT FOR PARTLY COMPLETED MACHINERY

This declaration relates exclusively to machinery products, except for partly completed machinery, in the state in which it was placed on the market, and excludes components, which are added and/or operations carried out subsequently by the final user unless there is a substantial modification of the machinery product.
